Does replacing slate in a Melbourne heritage overlay need a planning permit?

By Artigellence ·

Two council statements decide the first question. City of Melbourne says routine repairs that replace like for like need no permit under its Heritage Overlay if they do not change the appearance or significance of the place, and a Victorian council's heritage sheet says complete replacement of original or significant roof cladding generally does. The heritage page and the rules check cover the rest.

What the councils say

Do routine slate repairs need a permit in a Heritage Overlay?

Under the Heritage Overlay you do not need a permit for routine repairs and maintenance that replace ‘like for like’ so long as they do not change the appearance of the place or impact on its significance. The sheet from another Victorian council says the same of the rule itself: under Clause 43.0-1 of the Planning Scheme, a planning permit is not required for works, repairs and routine maintenance that do not change the appearance of the heritage place, if the proposal is carried out to the same details, specifications and materials as existing.

What about replacing the whole roof?

Generally, where existing original or significant roof cladding requires complete replacement, a permit is required. In City of Yarra's words, A planning permit is normally required to undertake works in a heritage overlay.

What does a council say replacement slate should be?

Salvaged slate should be reinstated in addition to replacement slates where necessary. The sheet adds that the new slate should match existing in profile, colour, texture and finish

What none of this tells you

Does this say my roof is in a Heritage Overlay?

No. It says nothing about any property. Each council's planning scheme and its schedule to the Heritage Overlay say which properties are in one, and each council applies its own policy.

Who decides in a case of doubt?

If you have any questions, or are unsure, please contact Council’s planning department. That is City of Melbourne's own line, and other councils will have their own planners to ask.

On the licence line, Victoria's Building and Plumbing Commission says that where the cost of domestic building work is more than $10,000 the parties must enter a major domestic building contract.
